CONSTITUTION

(as amended September 1980)

Preamble

We the undersigned, being desirous of serving the Cornell and Ithaca communities with the benefits of amateur radio by coordinating and developing our skills and knowledge, do hereby constitute ourselves the Cornell Amateur Radio Club (CARC) and do enact this constitution as our governing law.

Article I, Membership

Section 1, Full Member:

  1. A full time Student or employee of Cornell University is eligible for full membership. A valid FCC Amateur Radio License is also required for full membership.
  2. Upon meeting the eligibility criteria stated above, and upon fulfilling the following procedures, and individual will be considered as a full member of the CARC:
    1. Fulfillment of the club work requirement which can not exceed five hours per academic term nor be less that five hours per year. The nature and extent of this work will be determined by the executive committee.
    2. Payment of all dues (in full) as established by the Club.

Section 2, Associate Member:

  1. Non-voting Associate Member status may be accorded to the following groups upon payment of regular Club dues:
    1. Any full time student or employee of Cornell University who does not hold an Amateur Radio License.
    2. Any licensed Amateur Radio Operator who desires to support the Club and its operations.
  2. Associate members must fulfill the same work requirement as full members.
  3. Associate Members will be issued membership cards clearly indicating Associate Membership status.
  4. Associate Members shall NOT be given a key to the Club room. They shall be permitted to operate Club equipment only under the following circumstances:
    1. They are permitted to operate such equipment under their current FCC license.
    2. They have been checked-out on the equipment they wish to operate.
    3. A full-member of the CARC is present during the entire period of operation and shall be responsible for the conduct of the Associate Member.

Section 3, Honorary Members:

Any person that the CARC deems acceptable may be elected an honorary member by the majority vote of the membership present at any meeting. An honorary member may be exempted from all work requirements, dues, and deposits.

Article II, Rights and Responsibilities of all CARC Members

Section 1, Unlimited access to the Club premises at all times (Except with regard to Associate Members as stated above)

  1. A CARC membership card will be issued to all members.
  2. A Room Key shall be issued to all members. (in addition, a second key must be acquired from Safety Dispatch upon presentation to the dispatcher of a Valid, Full CARC Membership Card.
    1. A key deposit may be charged.
    2. A member will forfeit his key deposit if he does not return his key within one year after the termination of his membership.
    3. Keys are not transferable to other members or non-members.
    4. One half of the book value of the key deposits must be retained for refunds.

Section 2, All members shall abide by all FCC, Cornell, and CARC regulations while at the club premises or at any club event.

Section 3, Members must demonstrate a working understanding of any piece of club equipment before operating it.

Section 4, A member must post a copy of his current FCC license in the club premises before operating any equipment requiring possession of that license.

Section 5, Any member may be dismissed from the club upon willful or repeated violation of any club, FCC, or Cornell regulation.

  1. A special meeting shall be called within ten days of the alleged violation if possible.
  2. The alleged violator shall be given every possible opportunity to present his case.
  3. A 60% vote of the total membership is necessary to expel the alleged violator from the club.
  4. The alleged violator may appeal the club's decision to the University Ombudsman within ten days of the club's decision. The alleged violator must be notified of this right.
  5. There will be no refund of the dues of the expelled member.

Article III, Officers

Section 1, The officers of the CARC consist of a president, a vice president, a secretary, and a treasurer.

Section 2, All officers must be full time undergraduate students at Cornell University and full members.

Section 3, The executive committee shall consist of the four officers.

Section 4, The officers for the upcoming academic year shall be nominated at the preceding meeting and elected by a majority vote of the members present at the election meeting. The nominating meeting shall be held between two and four weeks following the beginning of the second semester. The election meeting shall follow the nominating meeting by not more than five weeks. Elections will be by secret ballot. Candidates are required to make a brief speech describing their qualifications and interests. If, at the election meeting there is no quorum, elections shall be held at a special meeting.

Section 5, Vacancies occurring between elections must be filled by special election at the first regular meeting at which the vacancy is announced. In the event of the vacancy occurring in the president's office, the vice president shall assume the office for the remainder of the term and a new vice-president shall be elected.

Section 6, The terms of the officers are from April 1 to March 31.

Section 7, An officer of the club may be removed upon enactment and execution of the following procedures:

    1. Any club officer who, on two successive occasions fails to attend the regular monthly meeting of the club CARC shall be removed from office unless a valid reason can be given for such an absence. A majority vote of the membership is needed to remove an officer from his office. This shall mean a majority vote of the membership resent at the next meeting following the two at which the officer has been absent. The officer in question shall be permitted to speak before the membership for the purpose of justifying such absence.

Article IV, Duties of the Officers

Section 1, President

  1. To preside over meetings.
  2. To call and preside over executive committee meetings.
  3. To represent the club at official functions.
  4. To coordinate the activities of all officers and committees.
  5. To delegate authority and make such appointments as he feels necessary.

Section 2, Vice-President

  1. To carry out any special assignments delegated to him by the president of the club.
  2. To take over in the case of the president's absence or negligence.
  3. To be responsible for club activities, special programs, and refreshments.

Section 3, Secretary

  1. To be responsible for all official club correspondence.
  2. To record minutes and attendance at all meetings.
  3. To send notices to members of meetings and special events at least one week in advance.
  4. To put meeting notice in the Cornell Daily Sun.
  5. To keep a current membership roster.
  6. To be responsible for the club library and equipment record.
  7. To keep the club record of all time put in towards fulfilling the club work requirements.

Section 4, Treasurer

  1. To collect dues and other fees.
  2. To pay all club bills and expenses.
  3. To keep accurate records of the club finances.
  4. To present the club budget request to the University Finance Commission each year.
  5. To coordinate all club purchases.

Section 5, Executive Committee

  1. The executive committee shall formulate and enforce all club policy, subject to review by membership.
  2. The executive committee can spend up to 20% of the maintenance budget for emergency repairs.
  3. The executive committee shall be responsible for making other appointments including but not limited to, QSL Manager, Traffic Manager, Chief Engineer, Station Manager, etc.
  4. The executive committee shall call all club meetings.

Article V, Advisor and Trustee

Section 1, In accordance with the rules of Cornell University, the president shall, with the approval of the membership, invite one or more Cornell faculty members be club advisors for an indefinite period.

Section 2, In accordance with the rules of the FCC, the president shall, with the approval other membership, appoint a station trustee. If possible, this trustee shall hold the highest class of amateur radio license available and be a permanent resident of the Ithaca area.

Article VI, Meetings

Meetings shall be held at intervals no greater than 31 days during the months of Cornell's spring and fall terms except during the months of final examinations. All members receive notification meetings at least 48 hours in advance. One third of the total membership shall constitute a quorum for the transaction of club business.

Article VII, Committees

Section 1, The executive committee and the membership may establish committees corresponding to the interests of the club.

Section 2, Each committee must submit an annual statement of its purposes and a list of members.

Section 3, Funding of Committees

  1. A committee must submit a detailed budget request to the club at the first of two budget meetings. At the first of these two meetings the committee shall be prepared to discuss its requests and produce specifications when requested by the membership.
  2. The meeting immediately following the first budget meeting shall be the second budget meeting. At this meeting the club membership may amend and vote on the committees' budgets item by item.

Article VIII, Club Calendar

Section 1, The club calendar is maintained to minimize conflicts in the station operating schedule. The calendar will indicate dates and time during which the station is reserved for radio communications, net and bulletin transmissions, personal schedules, and other activities.

Section 2, Major competitions, bulletin transmissions, amateur traffic net operations will be entered in the calendar first in that order of priority, subject to review by the members participating in them.

Section 3, After the special operations listed in section two have been entered, one hour personal schedules may be entered on a first come, first served basis. Entries in the calendar shall be made at least 24 hours in advance and no more than 30 days prior to the schedule. Only one operation may be scheduled a any given time, however operation of other stations on the club premises may continue with the consent of the scheduled operator.

Section 4, Casual operating (raw-chewing, DX-ing, routine contacts) and routine MARS operation shall not be entered on the calendar. Citizen's Band and CAP operation is banned from the club premises except when expressly approved by the membership.

Section 5, Any bona-fide EMERGENCY will take precedence over all other types of operation. In this context, emergency is defined as a situation endangering human life or property.

Article IX, Amendments

This constitution may be amended by a two-thirds vote of the members present, providing there is a quorum. Proposed amendments shall be presented in writing at a regular meeting and may not be voted upon until the next regular meeting. A copy of the proposed amendment shall be sent to each member at least one week in advance of the meeting at which it will be voted on.
